Terms of Service

These terms govern your purchase and use of Nowhere. By buying or using it, you agree to them.
1. Who we are
Nowhere is provided by Marcus Puchalla — Software Development, Gorkistraße 88, 04347 Leipzig, Germany (“we”, “us”). Contact: support@nowhere.fitness. Purchases are sold and processed by our Merchant of Record, Paddle.com Market Limited, whose Buyer Terms also apply.
2. The product
Nowhere is a privacy-first application for tracking under-desk and walking treadmills. A free tier provides local tracking. Plus — available as a subscription or a one-time lifetime purchase — unlocks additional features such as data export/import and optional cloud backup/sync. Features may evolve over time.
3. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Nowhere on devices you own or control, for your own use. A Plus entitlement is tied to your licence and may be limited to a number of activated devices (seats). You may not resell, sublicense, rent, or redistribute the application, or remove or circumvent its licensing.
4. Acceptable use
You agree not to misuse the service: no attempts to break, overload, or gain unauthorised access to our systems; no unlawful use; and no reverse engineering of the proprietary application except to the extent this restriction is prohibited by applicable law.
5. Open-source components
Nowhere works together with Trot, a separate open-source engine licensed under the GNU GPL v3, and includes other third-party open-source components under their own licences. Those licences govern those components; the Nowhere application itself is proprietary. Applicable notices are provided with the software.
6. Billing, renewal & cancellation
Subscriptions renew automatically at the then-current price until cancelled; you can cancel at any time and keep access until the end of the paid period. Refunds and cancellations are covered by our Refund & Cancellation Policy. Taxes are handled by Paddle as Merchant of Record and shown at checkout.
7. Not a medical device
Nowhere is a fitness and activity tool for general informational purposes. It is not a medical device and does not provide medical advice. Consult a qualified professional before starting or changing any exercise routine.
8. Warranty & liability
The software is provided “as is”, without warranties beyond those that cannot be excluded under applicable law. Nothing in these terms limits liability that cannot be limited by law — including liability for intent and gross negligence, for injury to life, body or health, or under the German Product Liability Act (Produkthaftungsgesetz). Subject to that, our liability for slight negligence is limited to the breach of essential contractual obligations and to the foreseeable, typical damage.
9. Changes
We may update the app and these terms. Material changes to the terms will be reflected here with a new date; continued use after a change means you accept the updated terms.
10. Governing law
German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of your country of residence remain unaffected. The EU online dispute resolution platform is available at ec.europa.eu/consumers/odr; we are not obliged to participate in proceedings before a consumer arbitration board.
